3. Account Registration & Security

To use certain features of the Service, you may be required to create an InstaLoop AI account and provide accurate, complete, and current information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Social Media Account Connections

InstaLoop AI may allow you to connect accounts from third-party social media platforms through their official authentication systems and APIs.

By connecting a third-party social media account, you acknowledge and agree that:

• You authorize InstaLoop AI to access information and perform actions permitted by the permissions you grant.
• You must comply with the terms, policies, community guidelines, and developer requirements of each third-party platform you connect.

InstaLoop AI is not responsible for restrictions, suspensions, account penalties, API changes, or other actions taken by third-party social media platforms as a result of your use of those platforms.

Unless expressly stated otherwise, InstaLoop AI is not affiliated with, endorsed by, or sponsored by any third-party social media platform.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You must not use InstaLoop AI to:

• Send unsolicited, deceptive, fraudulent, or spam communications.
• Harass, threaten, intimidate, abuse, or target individuals or groups.
• Distribute unlawful, defamatory, obscene, fraudulent, or otherwise prohibited content.
• Impersonate another person, organization, or entity.
• Misrepresent your identity, affiliation, or relationship with another person or organization.
• Violate the terms, policies, community guidelines, or developer requirements of any connected third-party platform.
• Circumvent platform rate limits, quotas, restrictions, or technical safeguards.
• Attempt to bypass InstaLoop AI usage limits or subscription restrictions.
• Collect, store, or process personal information unlawfully.
• Use the Service in violation of applicable privacy or data protection laws.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
• Probe, scan, or test the vulnerability of the Service or its infrastructure without authorization.
• Interfere with or disrupt the integrity, security, or performance of the Service.
• Introduce malicious code, viruses, malware, or other harmful material.
• Use automated means to access the Service in a manner that is not authorized by InstaLoop AI.
• Resell, sublicense, distribute, or commercially exploit access to the Service without our prior written permission.
• Use the Service for activities that violate applicable laws or regulations.

InstaLoop AI reserves the right to investigate suspected violations and take appropriate action, including restricting, suspending, or terminating accounts, removing content, reporting violations to appropriate authorities where required, and pursuing available legal remedies.

6. Subscription & Billing

InstaLoop AI may offer multiple subscription plans, including free and paid plans, depending on the features and pricing available at the time of purchase.

The features, usage limits, pricing, billing periods, and availability of each plan will be displayed on the InstaLoop AI website or within the Service.

By subscribing to a paid plan, you agree to the following:

Auto-Renewal

Unless cancelled before the renewal date, paid subscriptions may automatically renew at the end of each billing cycle.

You authorize the applicable payment provider to charge your selected payment method for the applicable subscription fees.

Payment Method

You must provide a valid payment method when subscribing to a paid plan.

You authorize InstaLoop AI and its applicable payment provider to process charges associated with your subscription.

Price Changes

InstaLoop AI may modify subscription prices from time to time.

Where required by applicable law, we will provide reasonable advance notice of material price changes. Updated pricing will generally apply from the beginning of your next applicable billing cycle.

Cancellation

You may cancel your subscription through your account settings or other cancellation method made available by InstaLoop AI.

Unless otherwise stated in our Refund Policy, cancellation will prevent future renewal while allowing continued access to paid features until the end of the current billing period.

Refunds

Refund eligibility is governed by the InstaLoop AI Refund Policy.

Failed Payments

If a payment fails, InstaLoop AI or its payment provider may retry the payment and/or restrict access to paid features until the outstanding payment is resolved.

You should independently verify important information generated by AI before relying on it for legal, financial, medical, professional, or other high-impact decisions.

9. User Content & Intellectual Property

You retain ownership of the content you create, upload, submit, or transmit through InstaLoop AI, including:

• Social media content
• Images and videos
• Captions
• Message templates
• Automation configurations
• Campaign materials
• Other content submitted by you

By using the Service, you grant InstaLoop AI a limited, non-exclusive, worldwide, royalty-free license to access, process, store, transmit, and display your content solely as necessary to provide, operate, maintain, secure, and improve the Service, subject to our Privacy Policy.

You represent and warrant that:

• You own or have appropriate rights to use the content you submit.
• Your content does not infringe another person's intellectual property or other legal rights.
• You have obtained any required permissions or consents for personal information included in your content.

10. InstaLoop AI Intellectual Property

The Service and all associated intellectual property, including its:

are owned by or licensed to InstaLoop AI and are protected by applicable intellectual property laws.

InstaLoop AI does not warrant that:

• AI-generated content will be accurate or error-free.
• Social media posts, messages, or actions will always be successfully delivered.
• Your use of the Service will result in any particular business, engagement, conversion, or revenue outcome.
• The Service will be completely free of bugs, errors, viruses, or other harmful components.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INSTALOOP AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, including but not limited to:

• Loss of profits
• Loss of revenue
• Loss of data
• Loss of business opportunities
• Loss of goodwill
• Loss of reputation
• Business interruption
• Loss resulting from third-party platform restrictions

arising out of or relating to your use of, or inability to use, the Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INSTALOOP AI'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) the total amount you paid to InstaLoop AI during the twelve (12) months immediately preceding the event giving rise to the claim; or (B) US $100.00.

Some jurisdictions do not permit certain limitations or exclusions of liability. In those jurisdictions, the limitations above will apply to the fullest extent permitted by applicable law.

14. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless InstaLoop AI, its officers, directors, employees, agents, affiliates, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from or related to:

• Your use or misuse of the Service.
• Your violation of these Terms.
• Your violation of applicable laws or regulations.
• Your violation of third-party platform terms or policies.
• Content submitted, published, or distributed through your account.
• Your violation of another person's rights.
• Unauthorized use of your account resulting from your failure to protect your credentials.

15. Termination

You may terminate your InstaLoop AI account at any time through your account settings or by contacting our support team.

InstaLoop AI may suspend or terminate your account or access to the Service, with or without prior notice where permitted by law, if:

• You breach these Terms or our Acceptable Use Policy.
• Your use of the Service creates a security or operational risk.
• You violate applicable laws or third-party platform policies.
• We are required to do so by law or a valid legal order.

Subject to our Privacy Policy and applicable retention requirements, InstaLoop AI may delete account information, automation configurations, connected account information, content, and other data associated with your account after termination.

Certain provisions of these Terms that by their nature should survive termination will continue to apply, including provisions concerning intellectual property, disclaimers, limitation of liability, indemnification, and dispute-related obligations.

InstaLoop AI reserves the right to update or modify these Terms from time to time.
